All ideas for the new law should be submitted to the ministry at www.moha.gov.vn by March 24. The law is expected to come into effect on January 1, 2020. According to the MoHA, many regulations are updated and clarified in the new law including recruitment policies and treatment of cadres, civil servants and other public employees. Notably, it would start to adjust the payment scheme to reward good performance rather than just seniority and ensure public servants are paid a living wage. Draft law on civil procedures under review
National Assembly deputies looked into the draft Law on Civil Procedures during their sitting at the 10 th session in Hanoi on October 26. The bill stipulates that those involved in any cases are responsible for scanning and sending letters of complaint and evidence to the court and their defendants, making it easier for all parties concerned to protect their legitimate rights and interests. Legislators shared the view that evidence and related materials should be authenticated before being sent to serve as foundation for the litigation. Regarding the jurisdiction of the jury of the Supreme Court of Appeals, they stressed the need to legalise its rights to make changes to a part or full verdict as well as the courtâs decisions in force. It can be done only when criteria are met, in order to avoid abuse. The Ministry of Justice held a forum for policy dialogue on perfecting laws on human rights in Hanoi on May 23. The forum aimed to update information and discuss issues relating to the improvement of laws on human rights in Vietnam . In his opening remark, Deputy Minister of Justice Hoang The Lien stressed that the Vietnamese State always pays special attention to protecting human rights. He noted that at national level, basic human rights are acknowledged in the Constitution, institutionalised in many laws and legal documents, and implemented in reality. At international level, Vietnam has actively participated in and strictly observed important international treaties on human rights such as the 1966 International Covenant on Civil and Political Rights, the 1966 International Covenant on Economic, Social and Cultural Rights and the 1979 International Convention on the Elimination of All Forms of Discrimination against Women. More new laws, resolutions made public
Hanoi (VNA) â The Presidential Office announced the Presidentâs decision to make public the Civil Code, the Penal Code, the Civil Procedure Code and Criminal Procedure Code during a press conference in Hanoi on December 18. The Law on Administrative Procedure, Law on Custody and Detention, Law on the Organisation of Criminal Investigative Agencies, and the resolutions on enforcing several laws and codes and the bailiff mechanism were also released. These laws, codes and resolutions were approved by the 13th National Assembly during the recent 10th session. Deputy Director of the Supreme Peopleâs Procuracy Nguyen Hai Phong said the Criminal Procedure Code comprises 9 sections, 36 chapters and 510 articles, which has been revised and supplemented to better ensure human rights and citizensâ rights in line with the 2013 Constitution.
